Negotiations over water rights are often difficult andcontentious. In an effort to shed some light on whatcould make them easier and more productive, two workshopswere convened with negotiators, stakeholders,mediators, and attorneys seasoned in the dynamics ofwater negotiations. The catalyst for these workshops wasthe effort to resolve water conflicts in Oregon's KlamathBasin by mediated negotiations. The Natural ResourcesLaw Center of the University of Colorado Law Schoolorganized the workshops with the goals of understandingwhy water conflicts are so difficult to resolve by negotiationand developing some practical guidelines for how toorganize and conduct a difficult water negotiation.The results of this effort, which are presented in thisarticle as 10 guidelines, represent a set of ideas, suggestions,and warnings from experienced negotiators tothose who are about to foray into the challengingworld of water negotiations.
